Terms of Service

These Terms of Service ("Terms") govern your use of the Teric Baseball mobile application, the tericbaseball.com website, and related services (together, the "Service") provided by Teric LLC ("Teric," "we," "us," or "our"). By creating an account, subscribing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Who can use Teric

Teric is for baseball players of all ages, their parents and guardians, and their coaches.

• If you are 18 or older (or the age of majority where you live), you can use the Service on your own.
• If you are 13 to 17, a parent or legal guardian must agree to these Terms for you, and you may use the Service only with their permission.
• If you are under 13, a parent or legal guardian must give the consent described in our Privacy Policy and agree to these Terms on your behalf before your account is created. Children under 13 may not create accounts on their own.
• To hold a coach account you must be at least 18 and have your team's or organization's authority to view and act on the training information of the players on your roster.

A coach is not a parent or guardian for purposes of these Terms and cannot agree to them for a player.

Parents and guardians

If you create or manage an account for your child, consent to an account for a child under 13, or give your child permission to use Teric, you agree to these Terms for yourself and on your child's behalf. You confirm that you are the child's parent or legal guardian. You are responsible for your child's use of the Service, for the information entered in their account, for any purchases made through it, and for supervising their training. You can review, change, or delete your child's information at any time — see our Privacy Policy.

Your account

You are responsible for the information you provide and for keeping your login credentials secure. You are responsible for activity that occurs under your account. Notify us promptly of any unauthorized use. We record the version of these Terms you accepted and when.

Subscriptions and purchases

Some features require a paid subscription or a one-time in-app purchase. The price, billing period and any free trial are shown before you confirm.

Where you can buy. In the app, subscriptions are sold through the Apple App Store or Google Play and are subject to their terms; payment is charged to your Apple or Google account. If we offer subscriptions on tericbaseball.com, they are sold by Teric LLC and billed by Stripe to the payment method you provide; web prices are in U.S. dollars and exclude any sales or use tax we are required to collect.

Automatic renewal. Subscriptions renew automatically at the end of each billing period, at the then-current price, until you cancel. On iOS, turn off auto-renewal in your Apple ID subscription settings at least 24 hours before the current period ends. On Android, cancel in Google Play subscription settings any time before the renewal date. For a web subscription, cancel any time from your account page on tericbaseball.com or by emailing support@tericbaseball.com; we confirm by email. Cancelling stops future charges; you keep access until the end of the period you have paid for. Deleting your account does not cancel a subscription — cancel it separately or it will keep renewing.

Free trials and introductory offers. If a plan includes a free trial or introductory price, the length and the price you will pay afterwards are shown before you start. Unless you cancel before the trial ends, it converts to a paid subscription. Introductory offers are limited to one per Apple ID or Google account per subscription, and one per customer on our website. Plan regeneration is not available during a free trial, and exercise-library access ends if a trial ends without converting.

One-time purchases and limits. Plan generations and regeneration packs are one-time, non-renewing purchases. Credits are consumed when used and are not refundable once used, except where the law requires. If a purchase is refunded, unused credits from it are removed. Player-initiated regenerations on a paid plan are limited to five in any rolling 30-day period.

Price changes. We will tell you before a price increase takes effect; it applies from your next renewal unless you cancel first.

Refunds. App Store and Google Play purchases are refunded, if at all, by Apple or Google under their policies. For a web purchase, contact support@tericbaseball.com within 14 days of the charge and we will refund it if you have not used the paid features in that period; otherwise refunds are at our discretion, except where the law requires one. A team plan bought from us directly (a sponsored roster) may be cancelled for a full refund within 30days of the invoice or charge date, whether or not it has been used; the roster’s coverage ends when the refund is issued.

Minors. If the player is under 18, the parent or guardian is the purchaser and is responsible for the charges.

Teams and coaches

If you join a team, that team's coaches can view your training plans, logged sessions, test results and how sessions felt, and can edit your training goals and position and generate or replace your plan. You can leave a team at any time in the app. If you are a coach, you confirm that you have your team's or organization's authority to enroll and coach the players on your roster, that you will use their information only to coach them, and that you will not enroll a player under 13 whose parent has not allowed team sharing. Sponsored access, where a team covers a player's subscription, lasts only while the team's sponsorship is active and you are on its roster; it ends when either stops, and we do not promise that a team will keep sponsoring you.

Your content

You keep ownership of what you add to Teric — your profile, photo, training data, feature requests, and messages to us. You give Teric a license to store, copy, display, and process that content to run and improve the Service, for as long as your account exists (and afterward only as described in our Privacy Policy). Your photo and name are visible to your teammates and coaches. Only upload a photo you have the right to use, and only of yourself or your child. Do not post anything unlawful, abusive, sexual, or that reveals another person's private information. We may remove content or hide a feature request that breaks these rules. If you send us ideas or feature requests, we can use them without owing you anything.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Give a false age or birthdate, or create an account for a child unless you are their parent or legal guardian.
• Impersonate anyone, or harass or bully teammates, coaches, or players.
• Share your login or use someone else's account.
• Reverse engineer, copy, or resell any part of the Service, or use it to build a competing product.
• Use automated tools to access the Service, or try to obtain paid features without paying for them, including through a team code you are not entitled to use.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to other users' accounts or our systems.

Training content and health disclaimer

Teric provides training plans and content for informational and educational purposes. Plans are generated by software from the information in your profile, and for players 13 and older an artificial-intelligence model reviews the plan and writes the coaching notes shown in the app. They can be wrong, incomplete, or unsuitable for a particular athlete, and Teric does not have a person review them before you see them. Teric is nota medical provider, and the Service does not provide medical advice. Consult a qualified physician or healthcare professional before beginning any exercise or training program, especially if you have an injury or medical condition. Use your judgment: skip or modify anything that does not feel right, and stop and seek medical attention if something hurts. Reporting pain in the app gives you general self-care information and, if you are on a team, notifies your coach; it is not medical care, and Teric does not monitor your reports or your training. You participate in any training activity at your own risk, and you are responsible for exercising safely and within your ability. If you are a parent or guardian, you acknowledge these risks on behalf of your child and agree to supervise your child's training as appropriate for their age and ability.

Intellectual property and license

The Service — including its software, design, branding, exercise library, training content, and 3D, video and image media — is owned by Teric LLC or its licensors and protected by copyright, trademark, and other laws. Portions include open-source software, fonts, models, and motion data used under their own licenses; see tericbaseball.com/licenses. TERIC, Teric Baseball, and the Teric logo are trademarks of Teric LLC.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control and to use the Service (a) for your own training, or (b) if you are a coach or team administrator, to coach the athletes on your team through the Service. You may not resell, sublicense, or provide access to the Service outside your team.

App store terms

If you obtained the app from the Apple App Store, Apple's Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula) also applies and, in a conflict about the app license, controls. These Terms are between you and Teric LLC only; Apple and Google are not parties, have no obligation to provide maintenance, support, or warranty service, and are not responsible for any claim relating to the app or your use of it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Communications

We send notices about your account, purchases, and these Terms by email to the address on your account (or, for a child's account, to the parent's address on file) and by notices in the app or on our website, and you agree to receive them electronically. Service messages — sign-in verification, password resets, parental-consent notices, trial and renewal reminders, plan-ready alerts, and notices from your coach — are part of the Service. You can turn push notifications off in Profile at any time. We will send marketing email only if you opt in, and every marketing email will include an unsubscribe link. If you accept these Terms for a child, you consent to the child's account receiving these service messages.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service and its users. If your account is deleted or terminated, your team memberships and any sponsored access end, and app-store subscriptions are refunded (if at all) only under Apple's or Google's policies — cancel them separately in your Apple or Google settings or they will keep renewing. We may also close accounts that have not been used for 18 months after emailing you first. Provisions that by their nature should survive termination will continue to apply.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular training outcome will be achieved. Some states do not allow the exclusion of implied warranties, so some of the above may not apply to you.

Limitation of liability

To the maximum extent permitted by law, Teric will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for all claims relating to the Service will not exceed the greater of (a) the amounts paid for your Teric subscription in the twelve months before the claim — whether to us, Apple, or Google — and (b) US$50. Nothing in these Terms limits liability that the law does not allow us to limit, including for death or personal injury caused by our negligence, gross negligence, willful misconduct, or fraud. Some states do not allow some of the limits above, so they may not apply to you; in that case our liability is limited to the fullest extent the law allows.

Indemnity

If someone else brings a claim against Teric because of your breach of these Terms, your content, or — if you are a coach — how you enrolled or dealt with players, you agree to cover our reasonable costs and any resulting liability. This does not apply to claims caused by our own breach or negligence.

Changes to these Terms

We may update these Terms. If we make a material change — for example adding a dispute-resolution provision or changing how subscriptions work — we will email the address on your account at least 30 days before the change takes effect and post a notice in the app or on our website, and we will not apply a material change to a dispute that arose before it took effect. If you do not agree, stop using the Service and delete your account before the change takes effect; any subscription will run out at the end of its current period. Changes that fix errors, add features, or are required by law take effect when posted. The date at the top tells you when these Terms last changed; earlier versions are available on request.

General

These Terms and the Privacy Policy are the entire agreement between you and Teric about the Service. If any part of these Terms is found unenforceable, the rest still applies. If we do not enforce a provision, we are not waiving it. You may not transfer your account or these Terms to anyone else; we may transfer them to a successor of our business. We are not responsible for delays or failures caused by events outside our reasonable control. Notices to us go to support@tericbaseball.com.
